Holiday Accommodation Broken Hill – Terms & Conditions

Please Note: Payment of the booking and/or deposit constitutes acceptance of these Terms and Conditions.

The Terms and Conditions of the holiday letting as agreed to by both parties are as follows:

a. “Booking” means the period for which you have paid to stay at the Property.
b. “Property” means any of ‘Holiday Accommodation Broken Hill’ properties, being either Maison de Chocolate or Gum Paddock Country Cottage, and all its fixtures, fittings and equipment.
c. “Management” means the owners and managers of the property.
d. “Renter” means the person(s) who made the booking.
e. “Guests” means the persons who stay overnight in the Property during the Booking.

2 Quotations- are subject to availability, are valid for a period of 7 days and are not guaranteed until receipt of full payment. All care is taken when quoting, however, if there is a mis-quote given or an incorrect price advertised on any third-party booking site, Management reserves the right to refuse the Booking or terminate the agreement.

Booking Requests – are subject to Clause 2, above. A
A Booking will be confirmed by Management once the application has been approved and initial or full payment has been processed.

For Bookings of one week or more, if the Booking is made 45 days or more before the rental commences, an initial rental deposit payment of 20% of the rental fee will be due at the time of booking.

If a Booking is made less than 45 days before the rental commences, or the reservation is less than a full week’s duration, the full rental fee must be paid at the time of booking.

In the event of a Booking not being accepted by Management, all fees paid will be refunded.

Any booking made within 10 days of the start of the rental period must be paid in full by credit card via PayPal, certified check or money order at the time of booking.

No Booking may commence without full payment being cleared.

Once a Booking is received and accepted by Management, the Renter is liable for payment of the balance of the rental fee. Non-payment will be treated as a cancellation and the deposit will be forfeited.

3 Occupancy of the Property – regardless of the published maximum number of persons the Property can accommodate, the number of Guests occupying the Property is strictly limited to those declared at time of Booking or any subsequent amendment notified to Management in writing, and agreed to by Management. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight Guests.

Exceeding the number of stated and agreed persons will result in immediate eviction without refund, or a $100 per Guest, per night, charge, at the discretion of Management.

All persons staying at the Property will be bound by the Terms and Conditions of this agreement.

4 Usage – the Property is let to the Renter for holiday purposes only. No parties, or large gatherings are allowed.

5 Check In/Check Out –the Property is strictly available from 2pm on the day of arrival and is to be vacated
by 10am on the day of departure.

Arrival and departure times may be varied, subject to availability,andmust be approved by Management, in writing, prior to your booking.

Variations to the standard check-in/check-out times will attract a further charge.

6 Keys – the Property is to be locked and the keys left inside the Property upon departure.

The Renter shall be liable for the cost to replace lost or broken keys. There will be a minimum charge $40.00.

7 Payment –full payment must be received prior to entering the Property, unless otherwise agreed, in writing, by Management.

Payments must be received in Australian Dollars. Management will not be liable for any bank or other
transaction charges.

Management accepts payment by the following methods: direct deposit into our bank account. Visa or MasterCard payments will incur a 2% surcharge, including GST. Amex and Diners are not accepted.

Personal cheques will be accepted if received at least 30 days prior to arrival.

Cash payments are accepted but must be received prior to entering the Property, no exceptions.

8 Cancellation or Variation – once a Booking has been accepted and confirmed by Management, a cancellation can only be made in accordance with the terms below:

If the period of Booking can be re-Booked, a refund for the period re-rented or the part thereof, will be issued.

If any part of the Booking cannot be re-Booked, the Renter will forfeit all monies paid for that period.

Management may refuse to amend a Booking once it has been confirmed in writing and any request to transfer the deposit to another Booking will be at the sole discretion of Management.

A variation of the Booking which reduces the number of nights stay will be a treated as a cancellation of the Booking in respect of those nights.

A variation of the Booking which reduces the number of guests will be treated as a cancellation of the Booking in respect of those guests.

If the Property becomes unavailable for your occupancy due to unforeseen circumstances (examples include, but are not limited to, fire, storm, damage, family illness) then Management will inform you immediately and refund any money paid prior to cancellation.

9 Equipment and Facilities – the Renter must report any inoperative or defective equipment to Management promptly!

Management will make every reasonable effort to repair or replace equipmentor appliances as soon as possible; however, there are limited service contractors in Broken Hill. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of air conditioning, dishwasher, washer, dryer, TV or other appliances.

Please be mindful of any maintenance reported to Management, as any issues which are user error will be charged to the credit card supplied.

10 Linen and Towels – the Property is supplied with linen, pillows, blankets and towels which must be left in the Property upon departure.

No linen or towels are to be removed from the Property, at any time.

The cost to replace linen and towels due to rips, tears or holes made by Guests, or the cost to professionally clean heavy soiling that, in every attempt, cannot be cleaned by Management will be charged to the credit card provided at time of booking.

11. Security Bond – A valid credit card number must be provided to Management upon confirmation of your Booking.

Any damage loss or expense incurred by Management as a result of Renter/Guest breach of these Terms &
Conditions will be charged against the credit card. Examples include but are not limited to any breakage, damage or excess cleaning requirements, extra Guests or Visitors beyond those declared.

If the Rental term is more than 14 days the owner may request an upfront bond of $500.00 from the Renter, to be held by the owner, on trust, until the end of the term. If a bond is held by Management it shall not limit any liability of the renter for damage, loss or expense incurred by Management.

Descriptions – Management has taken due care and responsibility to verify and check all information on our web site and third-party sites, brochures or any written or verbal material supplied, as at the time of compilation, however, as this information is subject to change, it accepts no responsibility for any inaccuracy in pricing or mis-description contained in the publications.

Condition of the Property – the Property will have been inspected prior to occupation and therefore the Renter undertakes to:

Notify Management immediately with regard to any damage and/or maintenance issues that require attention.

Keep the Property and all furniture, fixtures, fittings, chattels and effects in or about the Property in the same state of repair and condition as found at the commencement of the Booking.

12 Breakages – and losses to the Property are to be reported to Management and paid for immediately.

The Renter is responsible to Management for all breakage, damage and destruction to any property, direct and indirect costs, fines incurred, charges from third parties arising, and damage caused to the Property (including any contents) during the Booking.

The Renter agrees to indemnify Management against any losses or damages suffered by Management as a consequence of the Renter’s breach of its obligations under Clause 12 and to immediately, on demand, reimburse Management for all such costs.

13 Management accepts no responsibility for any loss, or damage, to any of the Renter’s personal belongings at the Property.

14 Additional cleaning – if required will be charged to the Renter at the discretion of Management.

15 Smoking – is not permitted inside the Property under any circumstances, no exceptions. If it is found that smoking has occurred inside the Property, the Renter will be liable for an additional cleaning fee and this cost will be at Management discretion.

Smoking is permitted within the boundaries of the Property provided the Renter ensures that all associated rubbish is removed at the end of the Booking.

16 Pets – are permitted at the Gum Paddock Country Cottage Property, please refer to conditions of the ‘Pet Policy’ on our website.

A $100 Pet Bond, per stay, is payable prior to your arrival.

A charge of $35 per pet, per stay is charged for all pet stays and is payable at the same time as the Booking payment.

Pets are not permitted at the Maison de Chocolate Property under any circumstances. Any evidence of pet occupation will result in………..

Management accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the Property. By making a booking, you agree that you have read and understood these Terms and Conditions and understand that Gum Paddock Country Cottage is ‘Pet-Friendly’ accommodation, thus any allergy you have to ‘any’ pet is not the responsibility of Management.

17 Departure – before departure, all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, and crockery and cutlery properly washed and packed away. The Property must be left in a clean and tidy condition.

Extra cleaning charges may be incurred for the cleaning of dirty dishes, BBQ, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc. Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee which will be charged to your credit card

All furniture and furnishings must be left in the position they were in when you arrived

The property should be vacated on time and secured. All windows and doors are to be locked. All keys must be left inside the Property or as otherwise directed by Management.

The Renter shall leave the Property in the same state of cleanliness and general order in which it was found. Failure to do so to the satisfaction of Management will result in a damage/cleaning charge being levied.

18 Disclaimer –Management does not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force of nature or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any other authorities, accidents, theft to or failure of machinery or equipment or industrial action.

19 Other Conditions of Booking – the Renter shall abide by these Terms and Conditions of Booking and any other instructions as shall be supplied in the Property or by Management.

20 Complaints – if the Renter is not entirely satisfied with the Property they must immediately contact Management.

In the very unlikely event that a complaint of the Renter is not addressed by Management during the Booking, the Renter may make their complaint, in writing, within 14 days after the end of Booking, to Management.

21 Insurance – The Renter undertakes that it will not do, permit to be done, or omit to do, any action that does or may
invalidate or adversely affect any insurance policy held by Management in respect of the Property and/or its contents.

22 Limitations of Liability – the Renter represents, warrants, acknowledges and agrees with Management that he/she will use the Property and its facilities in accordance with the Terms and Conditions above and the Information provided and that he/she does so at his/her own risk and that he/she indemnifies and saves Management harmless from any personal injury, sickness or death, loss or damage, however caused, to Guest or property of the Guest, his/her family, or guests, before during or after the time of Booking. Further, he/she accepts full responsibility for the use of the Propertyand agree to pay for any damage of said equipment, other than for normal wear and tear.
